Public Hearing on changes to the Department of Labor’s Administrative Rules

The Department of Labor will be holding a public hearing Adobe Acrobat Reader Symbol on amendments and additions Adobe Acrobat Reader Symbol to Lab 1300 Adobe Acrobat Reader Symbol.

 

The public hearing will take place on Thursday, November 21, 2024 at 10:00 a.m. at the New Hampshire Department of Labor, 95 Pleasant Street, Concord, NH 03301.

SB 269: Relative to tip pooling and sharing
December 27, 2023

On July 28, 2023, Governor Chris Sununu signed SB 269 into law.

 

Previously, tip pooling or tip sharing arrangements were only valid under the law if requested by an employee. With this change, employers are now permitted to discuss tip pooling or tip sharing arrangements provided they do not coerce employees into participating. It is important to note that the decision of whether to participate in a tip pool or tip share remains that of the employee. Additionally, service charges have been removed from the statutory definition of tips, meaning service charges are no longer tips and are not considered the property of the employee providing the service.


Please be aware that if the employer chooses to no longer accept tips and instead issues service fees, the employer will no longer have “tipped employees” and will be required to pay at least minimum wage.

Effective January 1, 2024 the standard mileage reimbursement rate for transportation expenses will be 67 cents per mile.

New MOP Email effective on October 18, 2023

ATTENTION:

 

Effective October 18, 2023 the NH Department of Labor will be changing the email address currently used for submitting NH Memo of Payment forms to coincide with an internal system upgrade. Please be advised that on the referenced date, Memos of Payment will no longer be accepted at MOP@dol.nh.gov.

 

Effective October 18, 2023, all Memos of Payment must be submitted to:

NH Warn Act and COVID-19
April 21, 2020
Under ordinary circumstances, some employers have NH WARN Act responsibilities concerning notification of layoffs or facility closures, but RSA 275-F:4 provides exceptions to these. Specifically, at RSA 275-F:4 I (b) and (d) there are exceptions which would relax the requirement. The NH Labor Commissioner has authority to determine the application of exceptions, and has expressed the view that COVID-19 is clearly an emergent, exceptional event.
